Assault Attorney in Dallas
Direct Attorney Defense for Assault Allegations
Assault allegations require close attention to what happened before, during, and after the reported encounter. At Kelley Legal, I defend people accused of assault in Dallas and personally handle each case from the first call through its resolution.
I represent clients facing allegations involving:
- Misdemeanor assault
- Aggravated assault with a deadly weapon
- Family violence and felony family violence
- Violation of a protective order
I intentionally limit the number of cases I accept, giving my clients direct attorney access and allowing me to examine the evidence, court requirements, and strategic decisions in each case.

Texas Assault Charges & Potential Penalties
Texas Penal Code § 22.01(a) recognizes several forms of assault. A person may be charged for intentionally, knowingly, or recklessly causing bodily injury, threatening another person with imminent bodily injury, or making physical contact that the accused knew or reasonably should have known was offensive or provocative.
An allegation involving bodily injury is generally charged as a Class A misdemeanor. Charges involving certain protected people or specified family violence circumstances can become felonies. Threat-based and offensive-contact allegations are generally Class C misdemeanors, although statutory exceptions can change the classification.
Texas misdemeanor penalty ranges include:
- Class A misdemeanor: Up to 1 year in jail and a maximum fine of $4,000.
- Class B misdemeanor: Up to 180 days in jail and a maximum fine of $2,000.
- Class C misdemeanor: A maximum fine of $500 with no jail sentence.
Felony exposure depends on the statute and circumstances alleged. Third-degree assault carries 2 to 10 years in prison, while a second-degree offense carries 2 to 20 years. Either may also carry a fine of as much as $10,000. The applicable range depends on the charged offense, any statutory enhancements, and court decisions in the case.
Focused Preparation for Your Assault Case
I examine the available evidence and test the initial police account against the full record. Depending on the case, my preparation may include:
- Reviewing police reports and dashcam footage
- Examining search procedures
- Assessing witness accounts
- Identifying other evidence that may affect the defense
I also explain court settings, filings, and strategic decisions in direct language so you can follow the case as it progresses.
I provide legal consultations, case discussions, and courtroom preparation directly in Spanish, allowing clients to discuss sensitive facts and prepare for court without a third-party translator.
A criminal plea can create immigration consequences involving visa status, permanent residence, or naturalization eligibility. I work alongside two immigration attorneys and can flag potential immigration consequences before a plea decision or other resolution. This review matters because a case outcome considered acceptable in criminal court may carry separate consequences under federal immigration law.
