Online Solicitation of a Minor

Online Solicitation of a Minor Defense in Irving

Direct Attorney Access for Online Solicitation Allegations in Irving

An online conversation can become the basis of a serious criminal investigation, even when law enforcement used an undercover identity and no meeting occurred. At Kelley Legal, I directly represent people accused of online solicitation of a minor in Irving and Dallas County. I’m founding attorney Erin Kelley, a member of the State Bar of Texas, and I work with each client from the initial consultation through the resolution of the criminal case.

I deliberately limit my caseload so I can give each matter focused attention. I also provide Spanish-language consultations, case discussions, and courtroom preparation directly through my practice. You can discuss the accusation, investigators’ requests, and any arrest without relying on a third-party translator.

What Texas Law Defines As Online Solicitation of a Minor

Texas Penal Code Section 33.021 defines a minor as someone younger than 17 or someone the accused person believes is younger than 17. That second definition applies in undercover investigations when an adult officer presents an online identity as a minor. The state must still establish the elements of the charged provision with admissible evidence.

Subsection (c) of the statute addresses knowingly soliciting a minor through the internet, email, text message, or another electronic message service to meet another person. The meeting-based provision requires an alleged intent that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse, meaning certain oral or anal sexual conduct under Texas law. The alleged conduct can also support prosecution under another applicable law, depending on the facts.

What to Expect After You Contact Me

I begin by evaluating the known facts and discussing your legal options before accepting the case. This conversation can cover the messages at issue, police contact, an arrest, a detention hold, and any upcoming court setting. I maintain 24/7 availability for urgent arrests and sudden court developments.

My representation and communication process includes:

  • Setting clear objectives: I discuss realistic goals involving dismissal, charge reduction, or a plea resolution without predicting a particular result.
  • Reviewing available information: I examine the accusation and identify evidence that must be obtained or evaluated.
  • Explaining each stage: I explain the purpose of upcoming proceedings and the decisions that may arise.
  • Providing ongoing updates: I keep you informed about hearing schedules, discovery disclosures, and court filing milestones.
