Texas Penal Code section 21.11 creates two distinct offenses. Indecency with a child by contact, a second-degree felony, covers sexual contact with a child under 17 with the intent to arouse or gratify sexual desire, including touching through clothing. It carries 2 to 20 years in prison and up to a $10,000 fine. Indecency with a child by exposure is a third-degree felony, punishable by 2 to 10 years.
Texas law doesn’t require prosecutors to prove the accused knew the child’s age. Prosecutors in Irving cases may also file charges under related statutes, including sexual assault of a child under Texas Penal Code section 22.011, aggravated sexual assault of a child, or continuous sexual abuse of a child, each carrying its own penalty range.
